New York RAISE Act sets the strongest AI transparency law in the country — frontier developers must publish safety/transparency protocols and submit to enforcement
New York's Responsible AI Safety and Education Act (RAISE Act) has been characterized by legal analysts as the strongest AI transparency law currently in force in the United States. It requires frontier-model developers to publish safety protocols, transparency documentation, and submit to state-level enforcement — going further than California SB 53 on the disclosure dimension.
The disclosure-strength differential is what makes the RAISE Act distinct. California SB 53 (Transparency in Frontier Artificial Intelligence Act) requires developers to disclose safety practices and submit to third-party audits but with significant carve-outs for trade-secret information. The RAISE Act narrows the trade-secret exemption considerably — companies must publish their safety frameworks in a form that allows independent verification, not just attestation. For Anthropic, OpenAI, and Google, that means the actual contents of their RSPs (Responsible Scaling Policies) become subject to public scrutiny in a way they haven't been under voluntary publication.
The enforcement-mechanism difference is the other operational distinction. SB 53 relies on the California AG for enforcement, which has historically been slow and resource-constrained on tech-industry matters. The RAISE Act establishes a dedicated AI safety office within the New York state government with explicit enforcement authority — closer to the model the EU AI Act uses. New York gets enforcement velocity that California doesn't. The combination — stronger disclosure plus faster enforcement — means the RAISE Act effectively sets the floor for what frontier-AI compliance requires, and other states (including the Illinois SB 315 framework) are explicitly modeled on it.
