EU AI Act Digital Omnibus agreement (May 7) extended HRAI compliance deadlines from August 2 2026 to December 2 2027 — corrected timeline for high-risk system obligations

The Digital Omnibus on AI agreement reached May 7 between EU Council, Parliament, and Commission extended high-risk AI system (HRAI) compliance deadlines: from August 2 2026 to December 2 2027 for Annex III use-based systems, and from August 2 2027 to August 2 2028 for Annex I product-regulated systems including medical devices. The August 2 2026 deadline widely cited through Q2 2026 is no longer the operative HRAI timeline.

The substantive piece is the HRAI-timeline restatement. Reporting through H1 2026 consistently cited August 2 2026 as the EU AI Act high-risk system full-applicability deadline. The May 7 Digital Omnibus agreement — first amendment to the EU AI Act since 2024 adoption — extended HRAI obligations by approximately 16 months for Annex III systems and 12 months for Annex I. This morning's article anchored on the August 2 deadline reflected the pre-Omnibus reporting that no longer applies to HRAI obligations.

The other H2 2026 EU AI Act dates remain operative. The Omnibus introduced two new prohibitions effective December 2 2026 — non-consensual intimate material generation and child sexual abuse material generation. Transparency obligations for AI-generated synthetic content placed on EU market before August 2 2026 were postponed from August 2 2026 to December 2 2026. Final Omnibus adoption is expected June with publication in July; until publication the May 7 agreement is the operative reference point.
